TERMS AND CONDITIONS FOR PARTICIPATION IN THE ULTIMATUM ONLINE ENGLISH LANGUAGE COURSE

1. The Provider and binding force of the Terms

1.1. The online course Ultimatum (hereinafter referred to as "Ultimatum") is organized and conducted by AVEST OOD (hereinafter "Provider"), identification code 203959703, registered office Bulgaria, Sofia, Kedar str., 8.

1.2. The Terms and Conditions for Participation in the Ultimatum Online English Language Course (hereinafter "Terms") are publicly available on the website https://www.ultimatumenglish.com. The Provider reserves the right to review and update the Terms, changes come into effect from the moment of their publication on the specified website.

1.3. By registering for participation in the Ultimatum and paying the participation fee in accordance with section 4, the Participant declares that he has read the Terms and agrees to comply with them.


2. Terms and definitions

2.1. Terms – the Terms and Conditions for Participation in the Ultimatum Online English Language Course.

2.2. Participant – individual who meets the conditions in p. 3.1 of the Terms, and has paid the participation fee.

2.3. Provider – legal entity that organizes and conducts the Ultimatum.

2.4. Ultimatum – provision of access to the Participant to study materials in the field of English language learning via the Learning Platform described in p. 2.4.

2.5. Agreement – agreement between the Provider and the Participant based on the latter's consent with the Terms, completion of the Registration Form and payment of the participation fee.

2.6. Learning Platform – online learning platform of the Provider, located at http://www.class.ultimatumenglish.com.

2.7. Official Website – the Provider's website https://www.ultimatumenglish.com.

2.8. Official Facebook Page – the Provider's Facebook page https://www.facebook.com/468119166859215.

2.9. Registration Form – completion of the form located on the Official Website by an individual, who meets the conditions in p. 3.1 and 3.2.

2.10. Assignments – practice assignments which the Participant receives every day during the Ultimatum.

2.11. Pricing Plans – pricing plans, Basic or Premium, one of which the Participant chooses when completing the Registration Form. The description of each Pricing Plan is provided on the Official Website.


3. The requirements for participation in the Ultimatum

3.1. Any legal person who has reached the age of 18 can become a Participant.


4. Registration and payment of the participation fee

4.1. Announcements, promotional materials, prices and other information on the Official Website constitute a public offer for the conclusion of an Agreement between the Provider and the Participant. The Terms constitute an integral part of the Agreement.

4.2. In order to become a Participant, the individual completes the Registration Form on the Official Website, indicating his / her first and last names, email address and the selected Pricing Plan described in p. 5.3, and pays the participation fee corresponding to the selected Pricing Plan.

4.3. By completing the Registration Form and paying the participation fee the Participant confirms that he/she has read the Terms and agrees to comply with them.

4.4. By completing the Registration Form and paying the participation fee the Participant confirms that his/her knowledge of English corresponds to the Intermediate level (B1 in the CEFR system) or higher.

4.5. By completing the Registration Form and paying the participation fee the Participant confirms that he has a personal computer with Internet access, which is necessary for access to materials located in the Learning Platform.

4.6. The participation fee is payed via PayPal or EasyPay. When paying with a credit card, the payment processing, including the card number, takes place via secure PayPal or EasyPay processing systems. The Provider does not have access to the Participant's confidential data, including his/her credit card number. When making the payment, the Participant must indicate the same name and email address that he/she indicated in the Registration Form.

4.7. After the receipt of the payment, before the Ultimatum start date, the Provider sends the Participant a username and password for access to the Learning platform. The Agreement between the Participant and the Provider comes into effect when the Provider sends the username and password to the Participant.

4.8. In case the Participant withdraws his registration and refuses to participate in the Ultimatum after completing the Registration form, his/her participation fee is not refunded.

4.9. The Provider assumes that the Participant's email address indicated in the Registration Form is correct and uses it for correspondence and in cases when Ultimatum materials are provided via email.


5. Conditions and participation rules

5.1. General conditions

5.1.1. The Ultimatum is conducted remotely via the Learning Platform, using the username and password provided to the Participant by the Provider, or by email correspondence. The Provider retains the right to decide which of these two methods will be used for the provision of materials to Participants. The email address for correspondence with the Provider is coach@ultimatumenglish.com.

5.1.2. The language of correspondence between the Provider and the Participant is English. The Provider is not obliged to answer questions and messages received in any other language.

5.1.3. English is the only language of the Learning Platform interface and any materials published on it. The Provider is not obliged to provide translations of the materials into other languages and is not responsible for situations when the Participant is unable to understand materials provided in English and complete the assignments.

5.1.4. Every day for a period of 30 (thirty) days from the start date of the Ultimatum, indicated on the Official Website at the moment of submission of the Registration Form, the Participant will receive English language learning materials for self-study. The materials will become visible to the Participant at 09:00 a.m. (Central European Time) on the relevant day. The provided materials are in the form of videos, slides, pdf-files and links to external resources on the Internet.

5.1.5. Every day, together with the materials, the Participant receives Assignments for practice. Completion of the Assignments is not a requirement for participation in the Ultimatum.

5.1.6. The Participant receives access to the materials in the Learning Platform for a period of 180 (one hundred and eighty) days from the relevant Ultimatum start date.


5.2. Pricing Plans

5.2.1. When completing the Registration Form, the Participant selects one of the two Pricing Plans described on the Official Website – Basic or Premium.

5.2.2. The Basic Pricing Plan includes access to the materials published in the Learning Platform and the Assignments.

5.2.3. The Premium Pricing Plan includes the following:

- everything from the Basic Pricing Plan, described in p. 5.3.2;

- review by the Provider of all submitted written Assignments, including correction of mistakes. Only those completed Assignments, which meet the criteria in the description and in p.5.3, will be reviewed. The Assignments will be reviewed and feedback will be provided within 3 business days from the date of the submission deadline for the relevant Assignment;

- the opportunity to ask the Provider questions related to the grammar and vocabulary of the English language, the materials and Assignments provided, by sending messages through the Learning Platform. Only questions in English are accepted, answers will also be received in English. The maximum number of questions a Participant can ask during the Ultimatum is 30 (thirty). Questions are accepted within 30 (thirty) days from the relevant start date of the Ultimatum.


5.3. Rules for completion of the Assignments for the Premium Pricing Plan

5.3.1. The Assignment description becomes visible to the Participant at 09:00 a.m. (Central European Time) on the relevant day.

5.3.2. The Participant can submit the completed Assignment within 48 (forty-eight) hours, starting from 09:00 a.m. (Central European Time) on the day when it becomes visible to the Participant. After 48 hours the submission of the completed Assignment becomes impossible.

5.3.3. The Assignments can include one of the following: writing essays on different topics; reading and watching materials on the Internet; photo, video and audio recording of the Participant and his/her surroundings; engaging friends for help with the Assignments (optional); etc. All the materials provided by the Participant as completed Assignments are published on the Learning Platform and may be shown to other Participants.

5.3.4. The completed Assignment is submitted via a special field in the Learning Platform, in the form of a text, a link to an external website, or an attached file.

5.3.5. The Participants are not allowed to copy or use other Participants' submitted Assignments, as well as information from the Internet, the author of which is not the Participant.

5.3.6. Materials published by the Participant in the Learning Platform and submitted to the Provider, including completed Assignments and comments, should not contain messages, images, etc. from the following list: pornographic, containing elements of sexual or other violence, or in any other way contrary to morality; directed against national safety, public order, health or against the rights and freedoms of other citizens; discrediting the reputation and good name of the Provider or a third party; threatening the life or health of a person; promoting discrimination based on sex, race, education, age or religion; calling for violence, crime, inciting racial, national, ethnic or religious hatred; advocating an aggressive or undemocratic ideology; violating human rights and freedoms; related to commercial, official or personal secrets and other confidential information; violating any property or non-property rights or legal interests of third parties and organizations, including property rights, intellectual property rights and others; contradicting the current legislation of the country of the Provider and the Terms; spam or advertising. The Provider is not responsible for such messages published in the Learning Platform or the Official Facebook Page by the Participants and third parties.

5.3.7. If a Participant submits an Assignment, publishes messages or comments that in any way violate the requirements of p. 5.2.10 and 5.2.11, he/she will be excluded from the Ultimatum, their access to the Learning Platform will be suspended, and the participation fee will not be refunded. The Provider reserves the right to remove all comments and submitted Assignments that violate the conditions in p. 5.2.10 and 5.2.11.from the Learning Platform and the Official Facebook Page.


6. Rights and responsibilities

6.1. The Provider is not responsible in case of loss or damage of data due to technical problems and unforeseen system failures.

6.2. The Provider has the right to use, change and adapt the materials provided by the Participants as completed Assignments, messages and comments.

6.3. The Provider has the right to restrict access to all courses and materials not intended for public use.

6.4. The Provider has the right to send participants information about new courses, events, and other information about the services provided by the Provider and its partners.



7. Copyright

7.1. All materials provided by the Provider to the Participant before, during and after the Ultimatum, in the Learning Platform, via email, on the Official Website, on the Official Facebook Page or in any other way, are covered by copyright and all rights are reserved.

7.2. The Participant understands that all the materials provided are subject to copyright and undertakes not to disseminate, during the Ultimatum and after its completion, in any way publicly or to third parties and organizations the materials and Assignments received from the Provider. The participant has no right to display, advertise, reproduce, use, save, translate, process, publish or represent publicly, copy, in whole or in part, the materials provided to him / her without the prior written consent of the Provider.

7.3. The Participant who violates the conditions in p. 8.2 is suspended from participation in the Ultimatum, and his access to the Learning Platform is terminated, the participation fee paid is not refunded.


8. Personal data

8.1. By participating in Ultimatum, the Participants agree to voluntarily provide their personal data (first name, last name, telephone number, address, email address, etc.) to the Provider and the courier firm delivering the prizes to the Winners, for purposes related to their participation in the Ultimatum and / or the delivery of prizes. Participants allow the Provider and its representatives to contact them by phone and email during their participation in Ultimatum and in connection with it.

8.2. Each Participant has the right to require the Provider to delete his personal data at any time by sending a letter to the email address coach@ultimatumenglish.com, following which the data will be immediately deleted. In this case, his/her participation in the Ultimatum is terminated, and the participation fee paid is not refunded.


9. Other

9.1. Disputes between the Provider and the Participants are resolved by reaching a mutual agreement. If it is impossible to reach an agreement, disputes are resolved by the competent court of the Republic of Bulgaria.
